Inventions, ideas and other creative outputs, whether in the form of artistic, literary or musical expression, are afforded a number of legal protections. These protections are found within a complex network of laws dealing with copyright, registered designs, patents and trademarks. A breach of recognised intellectual property rights, including passing off and the unlawful use of confidential information, can be actionable either under these laws or at common law.
Our team stresses the need for intellectual property rights to be dealt with in advance of creation or further development, especially given ownership does not always rest with the client.
This is often the case even if a third party is paid to assist in the creation or development of intellectual property.
