Native Title Legal Issues

Native Title may still exist over land that is not held under freehold or another form of perpetual title.Clients with interests in non-freehold land and, rural and mining clients in particular, will need advice and direction when dealing with lands that are already, or may become subject to, a native title claim.

Our lawyers will advise and represent clients in respect of claims under the Native Title Act. With much of rural Queensland held under grazing and term leases that are subject to renewal, native title resolution has assumed a far greater priority especially for those in the cattle industry.

Our lawyers have considerable experience in the representation of corporate and private clients in native title litigation, but also in the identification and resolution of native title matters affecting land outside of the formal litigation process.

Our lawyers can assist clients in satisfying the requirements for lease renewal under the Land Act by, among other matters, negotiating indigenous land use agreements (ILUAs).
